Butwinick Law Office Assists Six Clients with Bankruptcy Discharge of nearly $500,000 in Student Loan Debt

Butwinick Law Office, a bankruptcy law firm in St. Paul, Minnesota, assisted six clients with the bankruptcy discharge of student loan debts in 2023. The amounts of student loan debt discharged were:

  • $73,120.90 for client 1
  • $80,733.34 for client 2
  • $67,457.00 for client 3
  • $205,509.00 for client 4
  • $14,686.57 for client 5
  • $42,111.00 for client 6

This achievement marks a watershed moment for bankruptcy filers in Minnesota, as Butwinick Law Office leveraged recent legal developments that expanded the possibilities for discharging student loan debt in bamkruptcy. These cases underscore the evolving landscape of bankruptcy law, providing a beacon of hope for those burdened by the weight of student loans.

The new guidance issued by the DOE provides a clearer framework for determining when a borrower can have their student loans discharged in bankruptcy. It is designed to reduce the adversarial nature of bankruptcy proceedings involving student loan debts and to ensure fair and just treatment for borrowers demonstrating undue hardship.

Student loans can only be discharged by a specialized adversary proceeding process as part of a bankruptcy case.

“We are pleased to have been able to help these six clients get out from under the crushing burden of student loan debt,” said Jeffrey Butwinick, an attorney at Butwinick Law Office. “Student loan debt is a major financial obstacle for many people, and it can be very difficult to get out of. Bankruptcy can be a viable option for those who are struggling to repay their student loans.”

The six clients who were discharged from their student loan debt had a variety of reasons for seeking bankruptcy. Some had lost their jobs and were unable to make their loan payments. Others had significant medical expenses that made it difficult to afford their student loan payments. And still others had simply taken out too much student loan debt and could not afford to repay it.

“Bankruptcy is not a decision to be taken lightly,” said Butwinick. “But it can be a life-changing event for those who are struggling with overwhelming debt. If you are considering bankruptcy, we encourage you to contact us to discuss your options.”
