Minneapolis, MN (October 6, 2023) – Mike Fleck, a Wisconsin resident, successfully discharged $67,457 in student loans in bankruptcy court on September 1, 2023. Fleck's case, Case No. 23-3011, is one of the few cases in Minnesota where a court has discharged student loans in bankruptcy.

In bankruptcy, debtors can typically discharge most of their debts, including credit card debt and medical debt. Student loans were generally not dischargeable in bankruptcy until new guidance was issued on November 17. 2022 making student loans much easier to eliminate in a bankruptcy.

Fleck was able to prove undue hardship by showing that he had made every effort to repay his loans, but that he was unable to do so due to his financial circumstances. Fleck also showed that repayment of his loans would prevent him from meeting his basic needs. Fleck's case is a victory for student loan borrowers who are struggling to repay their loans.
